These Terms of Service ("Terms") govern your use of FOCUS Content Engine, a content creation, management, scheduling, and publishing service operated by Focus Business Consulting (פוקוס ייעוץ עסקי), Registered Business No. 307860106, Ashkelon, Israel ("FOCUS", "we", "us", or "our"). By using the service, you agree to these Terms.
1. Service Description
FOCUS Content Engine helps users create, organize, preview, schedule, upload, and publish content to supported social media platforms. Features may include content generation, media processing, connected-account management, publishing workflows, analytics, and platform-specific export formats.
2. Eligibility and Accounts
You must be legally able to enter into these Terms and authorized to connect any social media account you use with the service. You are responsible for maintaining the security of your account and for activity performed through your authorized connections.
3. Third-Party Platforms
FOCUS Content Engine integrates with third-party platforms such as TikTok, Meta, Facebook, and Instagram. Your use of those services remains subject to their separate terms, policies, technical limitations, and review requirements.
We do not control third-party platform availability, API changes, account restrictions, moderation decisions, review outcomes, or publishing limits.
4. User Content
You retain ownership of content you upload or create, subject to any rights belonging to third parties. You grant FOCUS a limited, non-exclusive license to process, store, transform, transmit, and display your content only as necessary to provide the service and perform actions you request.
You are responsible for ensuring that your content and instructions do not infringe intellectual-property, privacy, publicity, contractual, or other rights.
5. Publishing and User Approval
Where the service offers direct publishing, you are responsible for reviewing the content, destination account, privacy settings, disclosures, and publishing choices before approval. FOCUS may implement safeguards that require explicit confirmation before a real publication is submitted.
Scheduled content may require additional approval where required by a third-party platform. The service will not intentionally bypass platform consent or review requirements.
6. Artificial-Intelligence Features
Some features may use artificial intelligence to assist with text, design, or media preparation. AI-generated output may contain errors or require disclosure under applicable law or platform policy. You are responsible for reviewing output before use and for enabling any required AI-generated-content labels or disclosures.
7. Acceptable Use
You may not use the service to:
- Violate applicable law or third-party platform rules.
- Publish content you do not have the right to use.
- Attempt unauthorized access to accounts, systems, or data.
- Interfere with service security, safeguards, or publishing controls.
- Use the service for deceptive, fraudulent, abusive, or malicious activity.
8. Availability and Changes
We may modify, suspend, or discontinue features as the service evolves or as third-party platforms change their APIs or policies. We do not guarantee uninterrupted availability or successful publication of every item.
9. Disclaimers
The service is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee specific business, marketing, audience, revenue, reach, or engagement results.
10. Limitation of Liability
To the maximum extent permitted by applicable law, FOCUS will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from third-party platform actions, outages, account restrictions, content moderation, or API changes.
11. Suspension or Termination
We may restrict or suspend access where reasonably necessary for security, legal compliance, violation of these Terms, or protection of the service or third parties. You may stop using the service and disconnect third-party accounts at any time.
12. Privacy
Our handling of personal information is described in our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of the State of Israel, without prejudice to mandatory consumer or data-protection rights that may apply in another jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with an updated effective date.
